_IF FIRE BREAK OUT, AND CATCH IN THORNS, SO THAT THE STACKS OF CORN, OR THE STANDING CORN, OR THE FIELD, BE CONSUMED THEREWITH; HE THAT KINDLED THE FIRE SHALL SURELY MAKE RESTITUTION._ If fire break out. This refers to the common practice in the East of setting fire to the dry grass before the fall of the autumnal rains, which prevents the ravages of vermin, and is considered a good preparation of the ground for the next crop. The very parched state of the herbage and the long droughts of summer make the kindling of a fire an operation often dangerous, and always requiring caution, from its liability to spread rapidly. STACKS - or, as it is rendered, "shock," Judges 15:5; Job 5:26, means simply a bundle of loose sheaves....

6._If fire break out and catch in thorns_. This injury is somewhat different from the foregoing, for he who kindles the fire is commanded to make good the damage done by him, although there may have been no willful intention to do harm. For the incendiary who had maliciously destroyed either a cornfield or a vineyard was to be far more severely punished; here, however, mere carelessness is punished. Although no mention is made either of house or barn, still the law includes all similar cases requiring compensation from him who had kindled a fire even in an open field. But it seems that such a person would be blameless, because he could not. foresee that the fire would ignite the thorns; yet, in order that every one should take as much care of the property of another as of his own, God commands him to suffer the penalty of his heedless or stupid negligence....

Verse Exodus 22:6. _IF FIRE BREAK OUT_] Mr. Harmer observes that it is a common custom in the east to set the dry herbage on fire before the autumnal rains, which fires, for want of care, often do great damage: and in countries where great drought prevails, and the herbage is generally parched, great caution was peculiarly necessary; and a law to guard against such evils, and to punish inattention and neglect, was highly expedient.
