Numbers 35:33

_SO THESE THINGS SHALL BE FOR A STATUTE OF JUDGMENT UNTO YOU THROUGHOUT YOUR GENERATIONS IN ALL YOUR DWELLINGS._ These things shall be for a statute of judgment. The law of the blood-avenger, as thus established by divine authority, was a vast improvement on the ancient practice of Goelism. By the appointment of cities of refuge, the manslayer was saved, in the meantime, from the blind and impetuous fury of vindictive relatives; but he might be tried by the local court, and if proved guilty on sufficient evidence, condemned and punished as a murderer, without the possibility of deliverance by any pecuniary satisfaction. The enactment of Moses, which was in adaptation to the character and usages of the Hebrew people, secured the double advantage of promoting the ends both of humanity and of justice....

33._So ye shall not pollute the land_. In this concluding sentence, He again reminds them that, unless they should exercise severe justice against murderers, they would be guilty of sin against God; because the land stained with human blood is polluted, and lying under His curse, until expiation has been made. Again, since God dwells in the land of Canaan, having chosen His abode among the children of Israel, his sanctity is also profaned. The sum is, that, in every respect, care should be taken lest the land, which is sacred to God, should be contaminated by bloodshed....

9-34 To show plainly the abhorrence of murder, and to provide the more effectually for the punishment of the murderer, the nearest relation of the deceased, under the title of avenger of blood, (or the redeemer of blood,) in notorious cases, might pursue, and execute vengeance. A distinction is made, not between sudden anger and malice aforethought, both which are the crime of murder; but between intentionally striking a man with any weapon likely to cause death, and an unintentional blow. In the latter case alone, the city of refuge afforded protection. Murder in all its forms, and under all disguises, pollutes a land. Verse Numbers 35:33. _FOR BLOOD IT DEFILETH THE LAND_] The very land was considered as guilty till the blood of the murderer was shed in it. No wonder God is so particularly strict in his laws against murderers, 1. Because he is the author of life, and none have any right to dispose of it but himself. 2. Because life is the time to prepare for the eternal world, and on it the salvation of the soul accordingly depends; therefore it is of infinite consequence to the man that his life be lengthened out to the utmost limits assigned by Divine Providence. As he who takes a man's life away before his time may be the murderer of his soul as well as of his body, the severest laws should be enacted against this, both to punish and prevent the crime. 11. THE CITIES OF REFUGE CHAPTER 35 _ 1. The provision of the Levites: Forty-eight cities (Numbers 35:1)_ 2. The cities of refuge (Numbers 35:9) The cities of the Levites were scattered through the land. Genesis 49:7 is therefore fulfilled. The provision of cities for refuge is full of interest. The careful study of the purpose of these cities is recommended. Note especially that they were provided to give shelter for those who had killed a person unawares. The avenger of blood (Hebrew: _goel, which means to redeem) pursued the person and the city of refuge gave shelter. The death of the high priest resulted in liberty for all who were in the cities of refuge. It was the signal that they could

CONDITIONS LIMITING THE PRIVILEGE OF SANCTUARY. Anciently the holiness of a sanctuary extended to all who came in contact with it, so that the right of asylum was liable to be abused; but by this law protection at a city of refuge was to be refused to those homicides who in the judgment of the community, on the evidence of two witnesses, were guilty of murder, as inferred from (_a)_ the existence of previous enmity or evidence of premeditation, (_b)_ the use of a murderous weapon. Those who were guilty of manslaughter only (see Deuteronomy 19:4 f.) were safe within the city during the lifetime of the high priest: after his death they ceased to be liable to vengeance. Though the law promoted justice by discriminating between the intentional and the unintentional homicide, it still left the punishment of the former to private revenge instead of committing it to the community.
